Emmanuel Solicitors Limited has been granted permission under section 43 of the solicitors act 1974 to employ Roger Diavewa as a caseworker subject to the following conditions:
- Mr Diavewa will be employed as a caseworker. His role will be strictly limited to managing his own caseload under direct supervision, ensuring that all work is reviewed and approved by his supervisor. He will not have authority to act independently on any matter nor provide unsupervised client advice.
- Mr Diavewa will be supervised by Innocent Ikechukwu (SRA number 534559), the sole owner and manager of the authorised Firm. In Mr Ikechukwu's absence, supervision will be conducted by Yetunde Ojo of Anji & Ani Lake Solicitors (SRA number 8007358) under the formal supervision agreement.
- Mr Diavewa must not provide legal advice, make strategic decisions, or submit documents to any court, tribunal, or third party without prior approval from his supervisor, ensuring that all client-facing work is controlled and authorised
- All client advice, strategic decisions, and final submissions will remain under the control of his supervisor. Mr Diavewa must not hold himself out as having authority to act on behalf of the Firm.
- Mr Diavewa will have no responsibility for receiving or holding any client money. He must not be involved in any financial transactions, billing, or fee arrangements with clients, eliminating any risk of financial misconduct.
- The SRA is immediately informed of any proposed variation in Mr Diavewa's duties or his supervision arrangements. Any variation must not take place until permission is granted by the SRA.
- This approval will lapse in the event of Mr Diavewa leaving the firm, with any intended return to the firm requiring a new application.
- This approval and the conditions attached to it are subject to review at the absolute discretion of the SRA.
Reasons/basis
Roger Diavewa was made subject to an order under section 43 of the Solicitors Act 1974 on 10 September 2020. In accordance with section 43 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain our approval. The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.

Reasons/basis
Roger Patrick Diavewa also known as Patrick Roger Diavewa and Patrick Diavewa worked for Calices Solicitors, Riga Mews, 32 Commercial Road, London E1 1LN as a litigation para-legal, between 2014 and 22 November 2018.
Mr Diavewa misled the Family Court by writing to the Court representing that Calices Solicitors were acting for a client when that firm was not retained or instructed by that client.
He also forged documentation which he served on the Upper Tribunal, and he received fees due to Calices Solicitors into his own personal bank account. In this respect it was found that Roger Patrick Diavewa had acted dishonestly.
FINDING
Mr Diavewa, who is not a solicitor, was involved in a legal practice and has occasioned or been a party to an act or default which involved such conduct on his part that it is undesirable for him to be involved in a legal practice in any of the ways described in the order below.
ORDER
To make an order pursuant to section 43 that with effect from the date of the letter or email notifying Mr Diavewa of Wellingborough of this decision:
- no solicitor shall employ or remunerate him in connection with his/her practice as a solicitor;
- no employee of a solicitor shall employ or remunerate him in connection with the solicitor's practice;
- no recognised body shall employ or remunerate him;
- no manager or employee of a recognised body shall employ or remunerate him in connection with the business of that body;
- no recognised body or manager or employee of such a body shall permit him to be a manager of the body; and
- no recognised body or manager or employee of such a body shall permit him to have an interest in the body
except in accordance with the SRA’s permission.
He was also directed to pay costs of £1,350.
This Order is subject to an Appeal to the Solicitors Disciplinary Tribunal by Mr. Diavewa. The Order remains in force pending the SDT’s decision on the Appeal.
On 15 January 2021, the Solicitors Disciplinary Tribunal ordered that Mr Diavewa’s application for Revocation of the s43 Order be refused. The above Order therefore remains in force.
